These Terms of Service (“Terms”) govern your use of the website, applications, services, and SMS/text messaging program operated by Higley’s Media Group (“Higley’s Media Group,” “we,” “us,” or “our”). By using our services or opting in to receive text messages from us, you agree to these Terms.

SMS/Text Messaging Program Terms

Program Name: Higley’s Media Group

  1. Program Description. Higley’s Media Group operates a recurring transactional SMS program. When you provide your phone number and opt in, you will receive SMS messages related to your account and the services you have requested from us. These messages may include appointment and scheduling notifications, order and project updates, service notifications, customer support communications, and other transactional or service-related messages associated with your account. One-time login and verification codes are a separate, single-message program and are not an opt-in to recurring appointment or order texts. We do not use this program to send unsolicited marketing or promotional messages.

  2. How to Opt In. You may opt in by checking the unchecked SMS consent box and submitting your mobile number in the Higley’s Media Group Portal at checkout, when creating an agent account, when accepting an invite, on your profile settings page, or on a homeowner prep-checklist page. After you opt in we send a confirmation text. You may also text START, YES, or UNSTOP to the number you received messages from to re-subscribe after opting out.

  3. Opting Out. You can cancel the SMS service at any time. Just text “STOP” to the number you received the message from. After you send the SMS message “STOP” to us, we will send you an SMS message to confirm that you have been unsubscribed. After this, you will no longer receive SMS messages from us. If you want to join again, text START to that number or opt in again through the Portal.

  4. Help and Support. If you are experiencing issues with the messaging program you can reply with the keyword HELP for more assistance, or you can get help directly by emailing us at contact@higleysmedia.com.

  5. Carrier Liability. Carriers are not liable for delayed or undelivered messages. T-Mobile is not liable for delayed or undelivered messages.

  6. Message Frequency and Rates. Message and data rates may apply for any messages sent to you from us and to us from you. Message frequency varies based on your account activity and the services you have requested. If you have any questions about your text plan or data plan, it is best to contact your wireless provider.

  7. Supported Carriers. The program is available on all major US and Canadian wireless carriers, including AT&T, T-Mobile, Verizon, and others.

  8. Privacy. How we collect and use information, including mobile numbers and SMS consent, is described in our Privacy Policy. We do not share, sell, or provide your mobile phone number or messaging consent data to third parties or affiliates for marketing or promotional purposes.

  9. Consent. Consent to receive SMS messages is not a condition of purchasing any goods or services from Higley’s Media Group.

General Terms

Use of Our Services

You agree to use our website, applications, and services only for lawful purposes and in accordance with these Terms. You are responsible for maintaining the confidentiality of any account credentials and for all activity that occurs under your account.

Intellectual Property

Unless otherwise agreed in writing, all photographs, video, floor plans, and other media produced by Higley’s Media Group remain the intellectual property of Higley’s Media Group. Clients are granted a license to use delivered media for marketing the specific property for which it was produced. Media may not be resold, sublicensed, or used for unrelated purposes without our written permission.

Third-Party Services

Our website and applications may link to or integrate with third-party services. We are not responsible for the content, practices, or availability of third-party services.

Disclaimer of Warranties

Our services are provided “as is” and “as available” without warranties of any kind, whether express or implied, to the fullest extent permitted by law.

Limitation of Liability

To the fullest extent permitted by law, Higley’s Media Group will not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of our services.

Changes to These Terms

We may update these Terms from time to time. When we make changes, we will update the “Effective Date” at the top of this page. Your continued use of our services after changes are posted constitutes acceptance of the updated Terms, where permitted by law.

Governing Law

These Terms are governed by the laws of the Commonwealth of Pennsylvania, without regard to its conflict of law principles.
